Any order of a product appearing in the online store requires consultation and acceptance of these terms and conditions of sale. Clicking the confirmation of the order implies full acceptance of these terms. The click signifies a digital signature of accordance.
Object :
These terms aim to define the rights and obligations of parties in the online sale of goods offered by the company Art'et Miss to its consumers.
1. Order :
* To order, you must be age 18 or older.
* You can order either on the site by following the purchasing rubric, or by contacting us by phone at 33 (1) 42 71 79 07 or by fax : 08 21 90 17 48
* Confirmation of order :
The contractual information will be confirmed via email at the indicated address by the consumer in the order confirmation or by fax at the number provided by the customer.
* Proof of the transaction :
The records stored in the computer systems of the company Art'et Miss in reasonable conditions of security are considered proof of communication, orders, and payments beween the parties.
The filing of orders and invoices is a reliable and durable support system capable of being produced as evidence.
* Product Information :
All efforts have been made to ensure the accuracy of information presented on the site. The company Art'et Miss is not responsible for the consequences, incidental, or special damages arising from electronic transmission or the information provided, even if the company Art'et Miss was aware of the possibility of such damages. The photos, descriptions, and prices of the artworks are not contractual.
In ordering, you make an offer to buy the artworks that you have selected under the general conditions. These works are mostly unique pieces, thus the company Art'et Miss reserves the right to refuse the offer due to dual orders. In this case, the company Art'et Miss will contact you to inform you of the situation and propose an equivalent artwork. If you do not accept the suggestion, we will cancel your order that we can not provide and we will reimburse you any amount that you could have paid us for the artwork. The refund of these sums constitutes our only responsibility to you if we cannot deliver the pieces you have ordered.
* Shipping Fees:
The costs of shipping are calculated according to their order. They vary according to weight, destination, and mode of transportation mentioned in the order.
2. Terms of Delivery :
The products are delivered to the address indicated by the customer on their purchase order.
Delivery charges are determined by the postal service (indicative time in Europe: day+4, for the rest of the world : day+10). For faster delivery, it is necessary to contact the gallery.
The client must notify the carrier detection of the slightest trace of impact (holes, traces of crushing, etc.) on the package, and if the carrier has any reservations reject the package.
The reimbursement of any product found damaged during transportation, without any reservation issued on the receipt of the package can not be supported.
As with any shipment, it is possible to be delayed or that the product gets lost. In such a case, we contract the carrier to start an investigation. Efforts are made, as long as necessary, to find the package. When necessary, the company Art'et Miss will be reimbursed by the carrier and will refund the customer.
We disclaim any responsibility for delays due to the carrier, particularly in cases of loss of products, weather, or strikes.
Problems of delivery due to the carrier:
Any anomaly concerning the delivery (damage, missing products compared to the purchase order, damaged parcel, broken product...) must imperatively be mentioned on the delivery form of "reserve manuscripts" accompanied by the signature of the client.
The customer must confirm this probblem and address it to the carrier within two days following the date of delivery by mail with a return receipt stating such claims.
The consumer must send a copy of this mail to the address of the company Art'et Miss. Without this, we do not proceed with any refund.
Any claim not made within the time limits defined above can not be taken into account and releases the company of Art'et Miss of all responsibility to the customer.
3. Right of Withdrawl:
* The right to withdrawl applies only to individuals.
* In accordance with articles L. 120-20, the consumer has a period of seven calendar days to return, at its expense, the products that do not suit them. This period starts from the date of receipt of the consumer's order. All returns will be reported in advance to the the customer service of the company Art'et Miss. This product should be returned directly to the address of the gallery Art'et Miss.
* Only returned products will be accepted in their entirety, in their origiinal packaging complete and intact, and in perfect condition for resale. Any product that has been damaged or has damages to its original packaging will not be refunded, returned, or exchanged. This right of withdrawl is without penalty except for expenses of return by mail. Assuming the right of withdrawl, the client has the choice to request either the refund of amounts paid, or an exchange of the product. In the case of an exchange, forwarding will be at the expense of the consumer.
* In the case of exercising the right of withdrawl, the company of Art'et Miss will make every effort to reimburse the consumer within thirty days.
4. Payment of Artworks
* Credit Cards, Visa, Mastercard
o Purchases may be paid directly by credit card on the site, in which case delivery will be made upon a confirmation of the agreement of payment of the order. When you pay by credit card, you must complete your order by indicating to PAYPAL your credit card number and expiration date. Numerous access authoration servers are then activated to verify the data in order to prevent abuse and fraud. For this, the bank server PAYPAL is encrypted and all information conducted is incripted accordingly (protocol SSL). Nothing is transmitted clear on the web.
* By bank transfer:
We offer you the possiblity of making your payment by means of bank transfer.
The client must state in the transfer order, the customer number and purchase order number; transfer fees depending. The products ordered will be sent upon receipt of payment by the company Art'et Miss.

Your order will be validated and sent upon receipt of your payment. To expedite the process, do not hesitate to send our customer service confirmation of your payment issed by your financial institution.
Should your payment not be made within thirty days from the date you placed your order, you order will be cancelled.

o Purchases can be paid by money to Dominique Rémond, Galerie Art'et Miss 14 rue Sainte Anastase 75003 Paris, France. Delivery will be made only after receipt of your payment. Should payment not be made within thirty days from the date of your order, your order will be cancelled.
* By check
o By choosing this payment method, it is sufficient to send us your check payable to Art'et Miss at the address Art'et Miss, 14 rue Sainte Anastase 75003 Paris along with your order summary.
o Upon receipt of your check, we will ship your order.
o If you pay by check, it must be established in Euros ONLY.
o If the collection is not made within thirty days of the date of your order, your order will be cancelled.
5. Royalties
The copyright laws in France are governed by the Law of March 11th, 1957 and the Law of July 3rd, 1985, codified in the Code of Intellectual Property. According to Articles L.111-1 and L.123-1 of the Code of Intellectual Property, the author of an intellectual work enjoys an exclusive property right at its creation, without necessity of formalities (filing or registration), for a period corresponding to the calendar year of death of the author and 'seventy years after the benefits of his assignees.
The author and the company Art'et Miss agreed to be joint owners of rights of representation and reproduction. The rights of the buyer on a work are limited to private.
6. Duty applicable
* Not partial validation:
If any provision of these Terms are held to be validated or declared under any law, regulation or following a final decision of a competent court, other provisions shall remain in full force and scope.
